By participating in the Giveaway, you agree to abide by and be bound by these Official Rules and the decisions of Sponsor and Administrator, the independent judging agency, which are final and binding in all respects and not subject to appeal.

1. SCHEDULE

a.     The Giveaway will be offered from 12:00 p.m. Eastern Time (ET) on one calendar day to 11:59 a.m. ET on the immediately following calendar day (“Giveaway Day”).
b.     Sponsor’s computer shall be the official clock for all purposes of the Giveaway.
c.     Sponsor intends to offer the Giveaway starting 12:00 p.m. ET on DATE, 2019 and ending 11:59 a.m. ET on September 30, 2019, with each Giveaway Day constituting a separate and independent Giveaway.  But, Sponsor may cease offering the Giveaway prospectively by posting a notice to such effect on www.beautyroulette.com (“Website”). Barring the occurrence of a force majeure event (see Rule 10 below), Sponsor/Administrator will not terminate a given Giveaway day’s Giveaway once it has commenced.

 
2. HOW TO PLAY. Go to Website. Purchase any combination of beauty or skin care products offered for sale on the Website during a given Giveaway Day. Before paying for your purchase, select (1) of the following numbers: (1), (2), (3) or (4).  Check the box indicating that you have read, understand and agree to these Official Rules as well as Sponsor’s privacy policy addressing the collection, use and sharing of your personal information. Correctly input the CAPTCHA code when prompted. Then click the PLACE ORDER button to submit your Giveaway play. If the number you selected matches the number randomly selected by Administrator for that Giveaway Day, you are a potential winner of the prize: Sponsor will pay for the items you purchased. However, depending on the total, pre-tax cost of the items purchased, you may be responsible for shipping/handling costs (see Rule 5 below).

How to Play WITHOUT PURCHASE. Go to Website. Click the FREE SWEEPS PLAY link and complete the entry form with all required information, including your name, e-mail address, residential address, daytime telephone number, and credit card/debit card**. Select (1) of the following numbers: (1), (2), (3) or (4).  Check the box indicating that you have read, understand and agree to these Official Rules as well as Sponsor’s privacy policy addressing the collection, use and sharing of your personal information. Correctly input the CAPTCHA code when prompted. Then click the ENTER button to submit your Giveaway play.  If the number you selected matches the number randomly selected by Administrator for that Giveaway Day, you are a potential winner of the prize: two (2) beauty sponges (with a total approximate retail value of $34.99.)

**Your credit card or debit card will NOT be charged unless you are a potential winner of a prize. If you are not a potential winner, Sponsor will destroy its record of your credit card/debit card information.

3. RESTRICTIONS ON PLAY
   
a. BE CAREFUL IN SELECTING A NUMBER, BECAUSE ONCE IT IS SELECTED, THE SELECTED NUMBER CANNOT BE CHANGED.  No practice selections or do-overs are allowed.  

b. You will not be allowed to select a number and have a Giveaway play unless you have first accepted and agreed to these Official Rules and Sponsor’s privacy policy.

c. For purchase participants, Giveaway play will be voided (with Sponsor and Administrator having no liability as to same under any legal theory) if payment for purchase is declined for any reason.

d.  For purchase participants, Giveaway play is only available in conjunction with a new purchase of product(s) using a credit or debit card. Product return(s) and exchanges do not qualify for Giveaway play; payment via gift card also does not qualify.  

e. For purchase participants, should a dispute arise to the identity of participant, the participant shall be the individual whose credit or debit card was used to pay for the purchase. (The preceding includes but is not limited to product purchases made as a gift for another person.)

f.  There is a limit of (1) Giveaway play of any kind per three (3) hour period

g.  Giveaway play is not to be combined with any other offer, discount or promotion of Sponsor.

h.  The following acts constitute fraud, are prohibited and will NOT result in Giveaway play, with Sponsor and Administrator each reserving the right to pursue legal sanctions against individuals believed to be engaged in such acts:

(i)             Use of automated, programmed or robotic means of Giveaway play;

(ii)            For purchase participants, purchasing products other than in a bona fide sales transaction;

(iii)          Accessing the Website from a third party on-line Giveaway newsletter, group, “club” or the like;

(iv)           Publishing the Giveaway in a third party on-line Giveaway newsletter, group, “club” or the like, without the prior written permission of an authorized representative of Sponsor;

(v)            Any other act which is designed or intended to defraud Sponsor or Administrator as to Giveaway play, as determined in the sole discretion of Sponsor and Administrator.

 

4. SHIPPING/HANDLING ON PRIZES

Depending on the total, pre-tax cost of products purchased, the winner may be responsible for shipping and handling costs on prize. Standard shipping via the United States Postal Service will be used for prize delivery. For purchase participants, if the total, pre-tax cost of products purchased in a single transaction is $35 or more, the winner will not be charged for shipping/handling. For non-purchase participant winners as well as purchase participant winners where the total, pre-tax cost of products purchased in the corresponding transaction is less than $35, shipping/handling costs are $5.99: the credit card/debit card of non-purchase participant winners will be charged $5.99 at the time of prize award; for purchase participant winners, the amount credited to his/her credit/debit card will reflect only the total, pre-tax cost of products purchased (and will exclude the $5.99 payment for shipping/handling.)  If a non-purchase participant winner’s credit or debit card is declined for any reason, the prize will be forfeited without compensation of any kind.  IF YOU DO NOT WISH TO PAY FOR SHIPPING/HANDLING COSTS (TO THE EXTENT APPLICABLE), YOUR SOLE RECOURSE IS NOT TO PARTICIPATE IN THE GIVEAWAY.  

 

5. RANDOM SELECTION OF NUMBERS/ODDS OF WINNING

a.     Each Giveaway Day, Administrator will randomly select (1), (2), (3) or (4) as the winning number for all Giveaway plays for that Giveaway Day.  


b.     The odds of matching the selected number for a given Giveaway Day are 1:4.


6. WINNER NOTIFICATION

a. With the exception of a Giveaway Day which ends on a Saturday, Sunday or U.S. Federal holiday, potential winners will be notified by Sponsor by e-mail approximately six hours after the close of that Giveaway Day. But, should a Giveaway Day end on a Saturday, Sunday or U.S. Federal holiday, you should instead receive the e-mail notification at 6:00pm ET on the immediately following business day.  Weekend drawings will be grouped together for one drawing, announced at approximately 6 pm ET on Monday of a given week.

b.     A potential winner may be required to complete, sign and return an Affidavit of Eligibility, Liability Release and a Publicity Release (where lawful) within five (5) days of receipt of e-mail notification from Sponsor.  

c.     In the event of noncompliance with the Affidavit requirement (as applicable); if potential winner cannot be contacted for any reason despite  Sponsor’s commercially reasonable efforts to do so (including e-mail notification being returned as undeliverable, classified as “SPAM” or “junk,” or potential winner failing to timely respond to e-mail notification for any reason); or if potential winner is determined by Administrator and/or Sponsor to be ineligible or otherwise in violation of these Official Rules will result in prize forfeiture without compensation of any kind and such prize will not be awarded.

d.     If winner participated via purchase, Sponsor will advise winner’s credit card/debit card issuer to credit his/her account for the amount of purchase within three (3) business days of Sponsor’s  e-mail notification to winner  or winner’s return of completed and signed Affidavit (as applicable).

d.     If winner participated without purchase, Sponsor will ship prize to winner within three (3) business days of Sponsor’s  e-mail notification to winner or winner’s  return of completed and signed Affidavit (as applicable).

 

7. RESTRICTIONS ON PRIZE AWARD

a.     Winner will be solely responsible for all taxes on the prize.  If a person wins prize(s) totaling $600 or more in value in this and other Giveaway Days’ Giveaways offered by Sponsor, such person will be issued an Internal Revenue Service 1099 Tax Form, reflecting the total value of prize(s) won.  Such person further agrees to fully cooperate with Sponsor and its representatives as to properly reporting his/her prize winnings to the Internal Revenue Service, including by providing his/her Social Security Number upon request.


b.     If winner participated without purchase, no prize substitution is allowed except by Sponsor in its sole discretion due to prize unavailability for any reason and only then for prize of comparable value and the prize is not redeemable or exchangeable for cash.


c.     Prizes are not transferable except with Sponsor’s consent which may be granted or withheld in its sole discretion and without liability of any kind.
 

8.  ELIGIBILITY

Employees, officers and directors as well as members of their immediate families (parents, children, siblings, spouse; wherever they may live, and members of their household (whether related or not) of Sponsor, its parent company, affiliates, subsidiaries, and divisions; Administrator; and any other entities in any way involved in the development, production, design and implementation of the Giveaway are not eligible for the Giveaway.

9. LIMITATIONS OF LIABILITY

a.     Sponsor and Administrator assume no responsibility for:

(i)             any incomplete, incorrect or inaccurate information whether caused by tampering, hacking or by any of the equipment or programming associated with or utilized in the Giveaway or by any technical or human error of any kind;

(ii)            any problems or technical malfunctions of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, programming or failure of electronic transmissions on account of technical problems or traffic congestion on the Internet affecting the Website and/or Giveaway (including but not limited to random selection of winning numbers for Giveaway Days)

(iii)          any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of the Website and/or Giveaway (including but not limited to random selection of winning numbers for Giveaway Days)

(iv)           late, lost, illegible/garbled, incomplete, damaged, misdirected, corrupted, or jumbled purchase transaction data, non-purchase entry forms, and/or Giveaway plays; improperly recorded (or unrecorded altogether) purchase transaction data, non-purchase entry forms or Giveaway plays, regardless of cause.

 

b.     Force Majeure. If, for any reason, a given Giveaway Day’s Giveaway (or any part thereof) is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm or other natural cataclysm, riot, strike, civil commotion, governmental regulation, materials shortage or any other causes beyond the control of Sponsor which, in its sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of such Giveaway Day’s Giveaway (or any part thereof), Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend that Giveaway Day’s Giveaway and conduct that Giveaway  Day’s Giveaway  in a manner which is fair, equitable and in accordance with these Official Rules, as determined by Sponsor in its sole discretion.  Notice of such action by Sponsor will be posted at the Website.

 

c.     Prospective Changes. Sponsor reserves the right to modify these Official Rules prospectively for upcoming Giveaway Days’ Giveaways. Such modifications may include, by way of example only, the prize available to be won by non-purchase participants (as per Rule 3). Any material prospective modification will be disclosed on the Website in addition to the Official Rules.  You are strongly advised to carefully review the Official Rules prior to participating in the Giveaway on each Giveaway Day that you wish to do so.


11.  RELEASES

a.     By participating, entrant indemnifies, releases and agrees to hold harmless Beauty Roulette, Inc., its parent company, affiliates, subsidiaries, and divisions; National Sweepstakes Company, LLC; any other entities involved in any way in the development, production, design and implementation of the Giveaway;  and the directors, officers, agents, representatives, shareholders, employees, successors and assigns of any of the above organizations; from any and all liability arising from participating in the Giveaway, any Giveaway-related activity and/or the acceptance, receipt, possession or use/misuse of any prize (if applicable).
 

b.    To the fullest extent permitted by law, acceptance of a prize constitutes the winner’s agreement to the use of his/her name, address (city, state), likeness, photograph, other indicia of persona and/or statements made by winner regarding any prize, the Giveaway or the Sponsor for advertising/publicity/trade purposes by Sponsor and its designees without further compensation or review, approval or notice of any kind.



12. DISPUTE RESOLUTION/ CHOICE OF LAW 

To the fullest extent permitted by law, by participating in the Giveaway, you agree:

– that any action at law or in equity arising out of or relating to these Official Rules or this Giveaway shall be filed exclusively in the U.S. District Court for the Southern District of New York in New York, New York or New York State Court in New York, New York;

– to the personal and exclusive jurisdiction of such courts for the purposes of litigating any such action, waiving any right of change or venue, forum non conveniens or the like;

– that any such action shall be resolved individually, NOT as part of a class action;

-that any claims/judgments/awards shall be limited to actual out-of-pocket costs incurred (if any), with all other forms of damages, remedies and relief being expressly waived, and under no circumstances will you be awarded attorneys’ fees; and

– these Official Rules and this Giveaway shall be governed by the substantive laws of the New York State (i.e., without regard to the choice of law/conflict of law principles of New York State or of any other jurisdiction).

 
13.  WINNERS’ LIST

 

For the names of winners of prizes valued at over $25, send a 3” x 5” card on which you have hand-printed “BEAUTY ROULETTE GIVEAWAY” and, for the Giveaway Day you are inquiring  about, the Month-Day-Year (in English; not numbers) of the calendar days on which that Giveaway Day started and ended  as well as a self-addressed stamped envelope to Beauty Roulette, Inc., 318 McMicken Street, Rawlings, WY 82301 to be received no later than two (2) weeks after the ending calendar day of the applicable Giveaway Day. If such date is a Saturday, Sunday or U.S. Federal holiday, the winners’ list request must be received by the immediately following business day.  Winners’ list will be available approximately four (4) weeks after the ending calendar day of the applicable Giveaway Day.
